We cannot guarantee that following our recommendations will result in successful certification, as final certification decisions rest with the relevant certification bodies. Certification timelines, requirements, and outcomes may vary based on factors beyond our control, including changes in certification standards, certification body procedures, and the specific nature of your products and processes.
All content on our website, including text, graphics, logos, images, and software, is the property of silversummit AS and is protected by Danish and international copyright laws. Our methodologies, templates, and proprietary guidance materials remain our intellectual property. You may not reproduce, distribute, modify, or create derivative works from our content without express written permission. Any feedback or suggestions you provide regarding our services may be used by silversummit without restriction or compensation.
Fees for our services will be agreed upon before commencement of work and outlined in a separate service agreement. Payment terms are typically 30 days from invoice date unless otherwise specified. Late payments may incur additional charges as permitted by Danish law. All fees are exclusive of VAT and other applicable taxes, which will be added where required.
We understand that you may share confidential information about your products, processes, and business during our engagement. We commit to maintaining the confidentiality of such information and will not disclose it to third parties except as required by law or with your explicit consent. This confidentiality obligation survives termination of our service relationship.
To the maximum extent permitted by law, silversummit AS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services. Our total liability for any claims related to our services shall not exceed the fees paid by you for the specific services giving rise to the claim. This limitation applies regardless of the legal theory upon which the claim is based.
Our services are provided "as is" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will meet your specific requirements or that the certification process will be successful. Certification standards and requirements may change, and we cannot guarantee the accuracy of all information provided by third-party certification bodies.
These Terms of Service are governed by and construed in accordance with the laws of Denmark. Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the Danish courts. The parties agree to attempt to resolve any disputes through good faith negotiations before resorting to formal legal proceedings.
Either party may terminate our service relationship with reasonable notice as specified in the relevant service agreement. We reserve the right to terminate services immediately if you breach these terms or engage in conduct that we reasonably believe may harm our reputation or violate applicable laws. Upon termination, you remain liable for all fees incurred up to the termination date, and both parties' confidentiality obligations continue to apply.
We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices. We will notify you of material changes by posting the updated terms on our website and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the updated terms.
